1. OVERVIEW
This website is operated by Bandly, LLC ("BandlyStore", "we", "us", or "our"). By accessing or using our website, products, or services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Services.
Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products to you. However, all sales and transactions are solely between you and Bandly, LLC.
2. ELIGIBILITY
You must be at least the age of majority in your jurisdiction to use our Services. By using the Services, you represent and warrant that you meet this requirement.
3. PRODUCTS AND MADE-TO-ORDER NATURE
All products are made to order unless otherwise stated. Because of this, orders may not be cancellable once submitted.
We reserve the right to limit quantities, discontinue products, or refuse service to anyone for any reason at our sole discretion.
Product images are for illustrative purposes only. Actual colors and appearance may vary depending on device settings and production variations.
4. ORDERS AND ACCEPTANCE
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is not accepted until payment is processed and confirmation is issued.
If fraud, abuse, or suspicious activity is suspected, we may cancel or refuse orders without notice.
5. SHIPPING AND RISK OF LOSS
Shipping and delivery terms are governed by our Shipping Policy: bandlystore.com/policies/shipping-policy.
All delivery times are estimates and are not guaranteed. Once an order is transferred to a shipping carrier, risk of loss transfers to the customer. We are not responsible for delays caused by carriers, weather, natural disasters, labor disruptions, customs processing, or other events beyond our control.
6. RETURNS AND REFUNDS
Returns, replacements, and refunds are governed exclusively by our Return & Refund Policy: bandlystore.com/policies/refund-policy.
Because items are made to order, refunds are issued only in accordance with that policy and at our discretion.
7. INTELLECTUAL PROPERTY
All content on the Services — including designs, graphics, text, logos, and branding — is the property of Bandly, LLC or its licensors and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or exploit any content without prior written permission.
8. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, or non-infringement.
We do not guarantee uninterrupted, secure, or error-free operation of the Services.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Bandly, LLC and its owners, officers, employees, contractors, affiliates, and service providers shall not be liable for any indirect, incidental, punitive, special, or consequential damages.
In all cases, our total liability arising out of or relating to any purchase or use of the Services shall not exceed the amount paid by you for the product giving rise to the claim.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bandly, LLC and its affiliates from any claims, damages, losses, or expenses (including attorneys’ fees) arising from your violation of these Terms or misuse of the Services.
11. DISPUTE RESOLUTION – BINDING ARBITRATION & CLASS ACTION WAIVER
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product purchased (a “Dispute”) shall be resolved exclusively through binding arbitration administered by a recognized arbitration provider under its consumer arbitration rules.
Arbitration will take place in the State of Texas unless otherwise required by law.
You and Bandly, LLC agree that disputes will be conducted on an individual basis only. Class actions, collective actions, and representative proceedings are not permitted. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Either party may bring an individual claim in small claims court if the claim qualifies.
12. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. You consent to jurisdiction in the state and federal courts located in Texas for any matter not subject to arbitration.
13. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
14. CHANGES TO TERMS
We may update these Terms at any time by posting revisions to this page. Continued use of the Services constitutes acceptance of any changes.
